Terms of Service

1. Acceptance of Terms

By accessing or using GymBoard ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including account owners, staff members, and visitors.

2. Description of Service

GymBoard is a digital signage platform that allows gyms, training academies, and fitness studios to display class schedules, announcements, and other content on TV displays. The Service includes:

  • Web-based admin console for managing content
  • TV display applications for showing content
  • Cloud infrastructure for syncing data across devices

3. Account Registration

To use GymBoard, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You must be at least 18 years old to create an account.

4. Subscription and Payment

Free Trial

New accounts receive a 14-day free trial with full access to features. No credit card is required to start a trial.

Billing

After your trial, you must subscribe to continue using the Service. Subscriptions are billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis.

Pricing

  • Base subscription: $40/month (includes 1 location, 2 displays)
  • Additional locations: $15/month each (includes 2 displays)
  • Additional displays: $5/month each

Prices are subject to change with 30 days notice.

Refunds

We offer refunds on a case-by-case basis. If you're unsatisfied with the Service, contact us within 14 days of your payment and we'll work with you to resolve the issue or provide a refund.

5. Acceptable Use

You agree not to use the Service to:

  • Display illegal, harmful, or offensive content
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Resell or redistribute the Service without authorization
  • Use the Service for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your Content

You retain ownership of all content you upload to GymBoard (class schedules, announcements, logos, images). By uploading content, you grant us a limited license to store, display, and transmit that content as necessary to provide the Service.

You are solely responsible for your content and ensuring you have the rights to use it. We do not monitor or review user content but may remove content that violates these Terms.

7. Intellectual Property

The GymBoard name, logo, software, and documentation are our intellectual property. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

9. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

  • You retain access until the end of your current billing period
  • Your data is retained for 30 days, then deleted
  • No partial refunds are provided for unused time

We may cancel your account with 30 days notice, or immediately if you violate these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMBOARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Incorrect or outdated information displayed on signage
  • Service interruptions or downtime

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify and hold harmless GymBoard and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of California.
